(“Wavency”, “we”) makes available to its clients, including the performance dashboards that our clients access privately. By using the site or these tools, you accept these terms. If you do not accept them, please do not use them. Wavency Media inc. is a digital marketing agency based in Montreal, Quebec, Canada.
WHAT THESE TERMS DO NOT COVERThese terms do not govern the mandates entrusted to Wavency. Each mandate is governed by a separate service proposal, signed by the client and by Wavency, which prevails over this text in the event of any discrepancy. The processing of personal information is described in our
privacy policy, which forms an integral part of these terms.
ACCESS TO CLIENT DASHBOARDSCertain tools are reserved for our clients and our staff. You agree to keep the access credentials provided to you confidential, not to share them with third parties, and to notify us without delay if you suspect they have been compromised. We may suspend access without notice when we have reasonable grounds to believe it is being used without authorization, or when the mandate to which it relates ends.
SOCIAL MEDIA ACCOUNTS WE MANAGE FOR YOUWhen a mandate involves your social media accounts, you authorize us to access them for the sole purpose of carrying out that mandate. This access is granted by you, through the official authorization mechanisms of the platforms concerned (including TikTok, Meta and LinkedIn). We never ask for your passwords.
What we do with this access: we read the public and organic performance data of your accounts (number of followers, likes, posts, views, comments and shares) in order to produce your performance reports, and we display this data in the private dashboard to which only you and our team have access.
What we do not do: we do not resell or transfer this data to third parties, we do not use it for any purpose other than producing your reports and carrying out your mandate, and we do not download, republish or modify your content without your consent.
You may revoke our access at any time from the settings of the platform concerned, without going through us. Revocation ends our ability to read your data and may interrupt the production of your reports. We request from the platforms only the minimum permissions required for these uses, and we comply with their developer terms.
INTELLECTUAL PROPERTYThe content of the site (text, images, videos, trademarks, graphic elements and code) belongs to Wavency or its partners and is protected by applicable laws. You may not reproduce, distribute or exploit it for commercial purposes without our written permission. Deliverables produced as part of a mandate are subject to the provisions of the corresponding service proposal.
PROHIBITED USESYou agree not to use the site or our tools to attempt to gain unauthorized access to data or systems, to disrupt their operation, to extract their content on a large scale by automated means, or to contravene applicable laws.
AVAILABILITY AND LIMITATIONSWe make reasonable efforts to ensure that the site and the dashboards are available and accurate, but we cannot guarantee it. Some of the data displayed comes from third-party platforms and depends on their interfaces: we are not responsible for any interruption, change or inaccuracy attributable to them. To the extent permitted by law, our liability to you in connection with the site and the tools is limited to direct damages and does not include indirect damages, including loss of profits or business opportunities.
LINKS TO THIRD-PARTY SITESThe site may link to sites that we do not control. We do not necessarily endorse their content and are not responsible for it.
CHANGESWe may modify these terms. The version in effect is the one published on this page, and the date of the latest update appears at the top. Any significant change affecting our active clients will be communicated to them.
GOVERNING LAWThese terms are governed by the laws applicable in Quebec and Canada. Any dispute falls under the jurisdiction of the courts of the judicial district of Montreal.
